Yoga2me (“we,” “us,” or “our”) operates a mobile messaging program (the “Program”), which you agree to use and participate in under the following terms and our Privacy Policy (together, the “Agreement”). By opting in or participating in the Program, you confirm your agreement to these terms, including the requirement to resolve disputes through individual arbitration as outlined below. These terms apply solely to this Program and do not replace or modify any other agreements or policies that govern your relationship with us outside of this context.
How to Join:
You may opt into our Program through online forms, apps, or other enrollment channels. By doing so, you agree to receive marketing text messages from us at the number you provided, possibly using automated systems. While your consent allows us to send you such messages, it is not required to make a purchase. Message frequency may vary. Standard carrier message and data rates may apply.
How to Opt Out:
To stop receiving messages, simply reply with STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any text we send you. A confirmation message may follow. These are the only valid methods of opting out. Attempting to unsubscribe through alternative words or by contacting our staff directly will not be recognized as a valid opt-out.
Changing Your Phone Number:
If you plan to change or give up your phone number, you must first unsubscribe from the Program. Failure to do so may result in you being held liable for any costs or claims arising from messages sent to that number after it’s reassigned. This responsibility survives the end of your participation in the Program.
Indemnity:
You agree to protect and compensate us for any losses or legal costs (including attorney fees) that result from your failure to inform us of a phone number change. This includes claims under the Telephone Consumer Protection Act or similar laws.
What to Expect:
Messages may include updates, promotions, service alerts, and other marketing related to our products, services, or events.
Costs and Frequency:
There is no charge from Yoga2me to join or participate, but your wireless provider may charge message and data fees. Message frequency will vary based on your activity with us and other factors.
Help and Support:
If you need assistance, reply HELP to any message or contact us at support@yoga2me.com. Note that this email is for support only and cannot be used to unsubscribe from the Program.
MMS Compatibility:
If your device doesn’t support MMS (Multimedia Messaging Service), you will receive SMS (Short Message Service) messages instead.
No Guarantees:
The Program is offered “as is” and may not function properly in all areas or with all carriers. We are not responsible for message delays or failures. Delivery depends on your wireless provider and is beyond our control. T-Mobile and other carriers are not responsible for delayed or undelivered messages.
Eligibility Requirements:
You must own a mobile device with text messaging capability, use a participating wireless carrier, and have a mobile service plan. Some carriers may not support participation.
Age Restrictions:
You must be at least 13 years old to use this Program. If you are under 18, you must have permission from a parent or legal guardian. By using the Program, you confirm that you meet these requirements and are legally permitted to participate based on your local laws.
Prohibited Use:
You agree not to send content that includes:
False or defamatory information
Offensive language or discriminatory remarks
Malicious software or harmful code
Illegal products, services, or promotions
Personal health information protected under HIPAA or similar laws
Any material forbidden by your local laws
Dispute Resolution:
Any legal issue or disagreement between you and Yoga2me (or its agents) related to the Program will be handled through binding arbitration in New York State. The process will follow the rules of the American Arbitration Association (AAA). The arbitrator will be selected by agreement or by AAA, and will have relevant experience. Each party will share the arbitration costs unless the arbitrator decides otherwise. Claims must be handled individually; class actions and group arbitrations are not permitted. The arbitrator’s decision is final, and confidentiality will be maintained unless disclosure is legally required. This clause remains effective even if your participation in the Program ends.
General Terms:
You confirm that you have the legal right to agree to these terms. If any part of this Agreement is deemed invalid, the rest will still apply. We may update these terms at any time, and we’ll inform you of significant changes. Continuing to use the Program means you accept the revised terms.
